We only gather information we need to serve you better and will not - without your consent, - sell, share, or rent this information to others in ways different from what is disclosed in this statement except in cases where in good faith we believe that the law requires us to do so, it is necessary to protect Vitesse Inc. rights and/or property, or if circumstances necessitate acting to protect the personal safety of staff or of the public.
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice, except as described below. The term "outside parties" does not include Vitesse, Inc.. It also does not include web site hosting partners and other parties who assist us in operating our web site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety.

Sales Terms and Conditions
Vitesse, Inc. assumes no responsibility for any data or information furnished herein. All specifications on this web site are subject to change without prior notice. All prices are subject to change without prior notice. All parts herein will be invoiced at the current prices in effect at time of shipment whether or not reflected on this web site. All items offered and sold by Vitesse, Inc. are considered custom unless otherwise stated. All orders must be prepaid in advance. Some items must be assembled, manufactured or ordered, please inquire about the estimated ship dates when you place your order.
GA state residents will be charged 7% sale tax.

PAYMENT
We accept Visa, Master Card, Paypal or Money Order. All orders are custom and must be prepaid in advance. Please call to confirm your order before sending a money order.

SHIPPING - Delivery
All freight charges will be added to the invoice. Delivery terms shall be FOB seller’s location.

RETURNS
1. We will not accept unauthorized returns of any type.
2. No returns after 7 days from date order is received.
3. All authorized and pre-approved returns are subject to a 25% handling charge at our discretion.
4. There are no returns on electrical parts, including but not limited to: MAF, Chips, PiggyBacks, Wiring harness, Injectors
5. There are no returns on turbochargers, wastegates, boost controllers.
6. There are no returns on any custom order item.
7. There are no returns on used or damaged parts unless found to be defective by us.

Damage to packages must be noted by the customer at the time of receipt and reported immediately to the shipper. Hidden damage must be reported to carrier immediately. In both cases, damages are to be settled between the customer and the carrier. We will assist the customer if and when necessary. Our errors, miss-shipment, etc., will be handled immediately after being brought to our attention.

LEGALITY OF PARTS
Vehicles modified by use of some competition and sports parts listed in this catalog may no longer be lawfully used on public roads. Check your state and local laws before installing these competition and sport parts on vehicles intended for use on the public roads. We make no guarantee or warranty as to the legality of any parts listed in this catalog, except as stated. Certain parts manufactured and/or distributed by Vitesse, Inc. may be deemed not legal for sale on pollution controlled and/or street vehicles in certain states or countries. Customer warrants that he or she fully accept the legal responsibility for any and all parts purchased, and agrees to indemnify and 'hold harmless' Vitesse, Inc. from any and all matters arising out of non-legal use of such parts.

AVAILABILITY DISCLAIMER
The availability of certain items shown on this web site is limited and may not always be available for immediate delivery.

ERRORS, OMISSIONS, AND REFERENCES
We are not responsible for any errors or omissions on this web site, nor are we responsible for resultant damages caused either directly or indirectly from the same.

WARRANTY
All items on this web site are warranted to be free from defects in manufacture, material and workmanship prior to installation. Any alteration or improper use will void this warranty. The remedy for breach of this warranty shall be, at our option, the replacement, repair or credit of the defective merchandise. The determination of validity of warranty claims and the resolution of all warranty claims will be at our sole discretion. This warranty does not cover any direct or indirect costs, such as labor, arising from the use of our products. To make a defective product claim, return the defective unit to us at your expense (make sure to obtain a return authorization prior to shipping). This warranty expires after 30 days of the date of purchase. All competition, off-road and racing parts are sold "AS IS" without any warranty. Implied warranties including warranties of merchantability or fitness for a particular purpose are excluded.

Limitation on Liability
Vitesse Inc. will not be liable for lost profits, loss of business, or any direct, indirect, special, punitive, incidental, exemplary or consequential damages, or any damages whatsoever.

Indemnification
You agree to indemnify, defend, and hold harmless Vitesse, Inc., its officers, directors, employees, agents, licensers and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Legal Contract
These terms and conditions are a Sales Agreement between the Customer and Vitesse, Inc., Which constitutes a legally binding contract. The Customer accepts this Sales Agreement by making a purchase, placing an order, or otherwise shopping on the Site. References to you or your shall relate to the Customer; references to Vitesse shall relate to Vitesse, Inc. The terms and conditions of this Sales Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.

This Sales Agreement constitutes the entire agreement between the Customer and Vitesse, Inc., relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Vitesse, Inc. Electronic records (including signatures) that are otherwise valid shall be accepted under the Sales Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Vitesse, Inc.

In the event of any conflict between the terms and conditions stated on your purchase order and this Sales Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sales Agreement and our invoice shall control.

Governing Law Venue
THIS AGREEMENT AND ANY SALES HEREUNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF GEORGIA, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN FULTON COUNTY, GEORGIA FOR PURPOSES OF ANY SUIT, ACTION OR PROCEEDING ARISING OUT OF THIS SALES AGREEMENT.
